5 YEAR WARRANTY STATEMENT FOR LLD LIGHT PRODUCTS

5 YEAR WARRANTY (for repair or replacement only)

OBJECT
LLD Light guarantees that the “standard” lighting products (i.e. the products present in its own catalogues) are free from original manufacturing and / or functioning defects, when used and maintained correctly, for a period of 5 (five) years from the date indicated on the purchase invoice. With respect to the activation of this guarantee, the customer must fill out the dedicated form on the LLD Light website (www.lldlight.it) following the instructions therein contained and subject to acceptance of the conditions herein expressed within 30 days from the date of purchase. If any problems due to proven defects in the production occur during the five-year warranty period, LLD Light will repair the product or replace it with one of the same series or in any case equivalent, even if it is a subsequent series. It is also understood that the activation of the guarantee, following the request made by the customer by compiling the aforementioned form will take place only following a specific decision taken by LLD Light that will inform the customer. In particular, LLD Light reserves this decision by evaluating various elements (e.g. creditworthiness of the customer, characteristics of the project for which the products were purchased, etc.). In any case, the activation may not take place with reference to supplied products intended for projects which net value is less than Euro 3,000.00 = (three thousand / 00) (more precisely, this value must be understood as referring to the supply of products intended for a single project and with a one single destination). In case of non-activation, the legal guarantee remains valid. The guarantee also operates solely with reference to products supplied to professional customers ("customers"), intended as economic operators in the sector who purchase products directly from LLD Light for their subsequent marketing, in the realization of a specific project, about which all relevant information must be provided. Therefore, this warranty will not operate in any case, in favour of the final consumer, for whom national regulations of reference remain valid, which could be asserted directly against the seller. The guarantee is granted exclusively to the customer who has purchased the products directly at LLD Light and does not extend to any additional third party purchasers. Nobody is in any way authorized to change, modify or extend the terms of the warranty on behalf of LLD Light, in
any conditions. If the customer's request is accepted, LLD Light will provide an "identifier unique code" that the customer must keep and mention in all cases of exercise of the guarantee.

TERMS AND CONDITIONS
This warranty is valid for 5 (five) years from the date of purchase of the product. The date indicated in the invoice will be considered as the purchase date and will prevail over the one indicated by the customer in the online registration form. The warranty covers the original design and / or manufacturing defects of the standard products present within 5 (five) years from the invoice date. The notification of the defect will have to be forwarded to LLD Light within 8 (eight) days from discovery. It is understood that, once receiving the goods, the customer is responsible for verifying the compliance with the purchase order. Any discrepancies regarding quantity, type, appearance and anything else ascertainable through visual inspection (apparent defects), must always be reported in writing within the maximum term of 8 (eight) days from delivery. Meanwhile, the disputed items must not be installed, much less tampered with. In case of requests submitted after this deadline, the products will be considered compliant in all respects and the notification rejected. To benefit from the guarantee, the customer must provide a detailed documentation confirming the compliance with the conditions accepted at the time of the request. The warranty is also valid only for the first installation of the products; any subsequent installations will not be considered as covered by the warranty. The guarantee can be enforced only on condition that:
- The products are used in compliance with the specifications prepared and supplied for the product and its use (technical specifications);
- The wiring and installation of the products are carried out in accordance with the instructions attached to the products and by specialized technical personnel;
- The maintenance of products is carried out according to the instructions attached to them and by personnel specialized technician and no modifications nor repairs are made to the products without written authorization by LLD Light or not in accordance with the accompanying instructions;
- The customer has complied with the agreed payment conditions;
- The products for which the warranty is required are kept by the customer in the state they are for as long as necessary to allow LLD Light to carry out the necessary checks on the defects / faults complained of;
- The customer presents to LLD Light the purchase invoice and the 5 (five) year warranty certificate sent by LLD Light to the customer via e-mail to confirm the correct activation of the guarantee;
- The products supplied are installed in a suitable environment if considering temperatures, humidity and ventilation, as well as the absence of chemical, corpuscular or gaseous agents;
- The maximum use in the 5 (five) years does not exceed 4,000 (four thousand) hours per year (corresponding to 12 (twelve) hours of daily operation) and that, within these limits, unless otherwise established in the technical specifications relating to the product, its components and its use, the defect exceed the nominal failure rate of 0.2% over 1000 (one thousand) hours of use;
- The products operate at a maximum temperature not exceeding 45 ° C and a minimum temperature not below minus 20 ° C (-20 ° C), unless otherwise specified in the technical documentation of the product itself. For products installed outdoors, the maximum daytime temperature must not exceed 60 ° C, when the products are off. Finally, the products installed outside must be turned on no earlier than 30 (thirty) minutes after sunset;
- The products have not been exposed to any involuntary mechanical stress or have not suffered damage mechanical caused by vandalism, atmospheric agents, sand etc. ;
- Differences in shades of light and luminous flux occur only within the same supply of the product.
In fact, in case of subsequent supplies of products there may be differences in the chromatic characteristics if compared to the original products, due to technical progress and variations induced in use in the luminous flux and colour temperature of the products. In particular, please note that the colour and luminous flux tolerance for LED modules is not covered by the manufacturer warranty: luminous flux and colour performance are subject to a tolerance ± 10% in the case of a new LED module.

EXCLUSIONS
The warranty does not apply:
- in case of product defects due to unforeseen or unforeseeable events (including falls, jolts, etc.) and / or force majeure (including electric discharges, lightning strikes), which cannot be attributed to a defect in the production process of the product;
- in case of defects or non-conformities deriving from any abuse, misuse, anomalous use or from violation of any standard, applicable instructions for use, including, as not exhaustive example, those contained in the most recent safety, sector and/or electrical standards for each country;
- power supply conditions, including power peaks, over / under-voltage and corrugated current control systems beyond those defined by the specific power supply standards;
- in case of products used with different power supply from what is reported in the LLD Light catalogues or products powered by third party power supplies not authorized by LLD Light;
- if the installation of the product is carried out on installations with a power factor imbalance less than 0,8;
- if following the occurrence of an electrical defect, it is found that the product is installed on systems without over-voltage protection systems of any kind (e,g, over-voltage, impulse disturbances generated by inductive loads);
- in case of defects resulting from impulse surge disturbances of amplitude and duration exceeding 1000V between conductor and conductor (L and N) and 2000V between conductor and ground (L and PE, N and PE), in compliance with EN 61000-4-5: 2005-11;
- when the damaged surface is less than 5% of the entire surface of lighting fixture;
- regarding the degradation of plastic components (for example polycarbonate) to the extent that they become discoloured or flake apart due to the natural ageing process (e.g. ageing generated by the UV rays of sunlight);
- regarding the surface colour variations in lighting fixtures installed outdoors at a distance of less than 5 km from the coast.
Furthermore, the warranty does not cover:
- varnishing defects caused by contact of the product with the ground, with chemical substances and fertilisers, with water containing corrosive chemical agents and in case of the generation of stray electric currents in the proximity of the product, caused by galvanic corrosion;
- all ancillary costs related to the repair of the defect (such as those for assembly and dismantling, lifting devices, scaffolding, the transport of the defective product, the repaired and new product, disposal, diaries and transfers), that will be charged to the customer;
- special, incidental and consequential damages such as, for example, loss of economic profit, property damage or other costs not previously mentioned;
- plastic parts, such as polycarbonate and PMMA that discolour and become brittle due to the natural ageing process.

PROCEDURES FOR INTERVENTION UNDER WARRANTY
In case a product defect is found within the warranty period, the customer must send a specific written request within 8 days from the discovery of the defect to the sales office of LLD Light, reporting their data (name, address, telephone number), copy of the invoice as proof of purchase and the identification code assigned when issuing this warranty, specifying in detail the defect/s found and the conditions of use of the product in object.
In case the proven defectiveness of the product is within the scope of this warranty, LLD Light will, at its discretion, repair the product or replace it (partially or in its entirety and with identical or similar product in design and having equal or superior performance). The repair or replacement of the product or its components does not activate a new warranty (on the repaired or replaced product or on the replaced components), as the product is covered by one warranty only.

APPLICABLE LAW AND JURISDICTION
Only Italian law will apply with the declared exclusion of conflict of laws rules. The Court of Vicenza will have exclusive jurisdiction over any dispute that may arise regarding the interpretation, activation, effectiveness, fulfillment of the warranty.
